Los límites jurídicos de la potestad de dirección del empleador. Una sistematización de sus principales dificultades teóricas y prácticas en Chile

This research aims to examine the practical challenges associated with the exercise of managerial authority by employers in Chile, particularly in relation to the legal protection of workers. The article forms part of the author's doctoral research and is structured in two main sections. The first section establishes the theoretical framework, outlining the conceptual foundations and normative principles underlying managerial authority. This provides a basis for identifying the key contours of the institution and the contentious issues that arise. The second section systematically analyzes the challenges related to managerial power, internal workplace regulations, and business directives, with a particular focus on their implications for the determination and modification of job functions, working hours, and workplace locations. The main finding of this study is that the Chilean labor regulatory system is grounded in an individualistic perspective, which serves as the foundation for managerial and organizational authority.Consequently, the research highlights the necessity of a system of legal constraints to ensure the effective exercise of labor rights and to rebalance the distribution of power within the workplace.
