The Legal Effect of a Decision to Dismiss a Criminal Case on the Administrative Accountability of a Public Employee A Comparative Analytical Study under Omani and Egyptian Legislation

This study addresses the evidentiary value of the decision to dismiss a criminal case and its effect on administrative disciplinary authority under Omani and Egyptian legislation, given that this issue represents an intersection between the rules governing disciplinary liability and those governing criminal liability. The study concludes that the dismissal decision constitutes a judicial act that acquires a temporary res judicata effect, which prevents reopening the investigation regarding the same facts and the same individual unless new evidence emerges. Despite the judicial nature of the dismissal decision, the general rule is the independence of disciplinary and criminal liabilities. Consequently, the evidentiary authority of the dismissal decision does not extend to administrative disciplinary proceedings, and the disciplinary authority retains the right to hold the employee accountable for the same act whenever the violation of functional duties is established, regardless of the grounds upon which the dismissal decision was based. An exception is made to this general rule in cases where the dismissal decision is grounded on the non-existence of the incident or the lack of attribution to the employee, in which case the disciplinary authority is bound by the dismissal decision due to the absence of the basis for misconduct. Moreover, the dismissal decision may influence the discretionary assessment of the administrative sanction, preventing excessive punitive measures, particularly when the dismissal was issued due to the absence of harm.
