Donald Trump’s Unitary Executive: Overcoming the Constitution; El poder ejecutivo unitario de Donald Trump: superando la constitución

This article explains that United States President Donald Trump has created a unitary executive branch of government and used it to overcome democratic constitutionalism in the United States. It shows that President Trump, with the active support of the United States Supreme Court, has personally subjugated the executive branch of government, making it a tool for destroying the rule of law. This article also examines Trump’s abuse of emergency authority to speed the demise of American democracy. It then explains how abuse of the unitary executive’s power has destroyed the legislative check on presidential power and greatly eroded the judicial check. It closes with discussion of signs that Trump has started a transition to a military dictatorship, going beyond the models that have informed scholars’ understanding of the Trump threat in the past. This article compares Trump’s destruction of the U.S. Constitution with attacks on liberal constitutionalism in Hungary, Turkey, Poland, and other countries, building on the findings of my book, The Specter of Dictatorship: Judicial Enabling of Presidential Power. The Specter of Dictatorship: Judicial Enabling of Presidential Power.
