Legal Implications of Live In Relationships in Indian Jurisprudence: Evolution, Recognition, and Challenges
Live-in relationships, once considered a social taboo in India, have gained increased visibility in recent decades due to changing societal norms, urbanization, and growing individual autonomy. These relationships involve two individuals cohabiting without entering into a formal marriage, raising significant legal and social questions in a society where marriage is traditionally considered the foundation of family and legitimacy. This research paper aims to examine the legal implications of live-in relationships within the framework of Indian jurisprudence. It explores how courts have interpreted and addressed issues such as legal recognition of such relationships, the rights to maintenance and protection for women, and the status of children born out of these unions. The paper also discusses relevant statutory provisions, including those under the Protection of Women from Domestic Violence Act, 2005, and key judicial pronouncements that have shaped the legal landscape. The study follows a doctrinal research methodology, analysing case laws, statutory provisions, and scholarly commentary to assess how the Indian legal system is adapting to evolving social realities. The paper underscores the significance of establishing a clear and consistent legal framework to protect the rights of individuals in live-in relationships, while balancing social values and constitutional rights.
