EU Financial Regulation and Private Law in the New Geopolitical Reality
The rise of financial regulation in the private law domain raises intricate questions about the interplay between EU financial regulation and private law. What is the role of the public/private divide in EU financial regulation? How does the legal grammar of EU harmonisation measures influence the relationship between regulatory standards with a European origin and national private law norms, and the way such measures are enforced? And how should EU financial regulation and private law ultimately relate to each other? While significant scholarly attention has been devoted to the relationship between EU financial regulation and private law, this chapter revisits this relationship in the light of a new geopolitical reality characterised, in particular, by the unravelling of the post-World War II global order and the global surge of autocratic powers and anti-democratic forces that the EU should navigate. It argues that the immense challenges facing the EU require a more integrated approach to EU financial regulation and private law at both the EU and national levels.
