Data Protection Challenges and Opportunities in Nigeria: Balancing Technological Innovation with Privacy in the Era of Energy Transition

The rapid advancement of technology in Nigeria, particularly in the energy sector, is not without its peculiar opportunities and challenges, especially in the area of data protection. While the transition of the most populous country in Africa to sustainable and cleaner energy is highly commendable, incorporating data-driven technologies such as smart grids, internet of things (IoT), and big data analytics presents new privacy concerns. The Nigeria Data Protection Act (NDPA) 2023 is the principal legislation that governs data privacy in Nigeria, yet the pace of development in technology has a tendency to outrun the ability of the law to adapt to emerging challenges. This paper explores the myriads of data protection challenges prevalent in Nigeria as the country attempts to balance technological innovation with the protection of privacy rights. It examines the extent to which the NDPA has been successful in addressing the privacy aspect of digital technologies, particularly in the energy sector, and identifies significant enforcement gaps as well as the imperatives of legal adaptation to new technology realities. Adopting a doctrinal methodology, the article found that although Nigeria is trying to keep up with the regulation of technological advancements, the current legal framework is not robust enough to effectively regulate the rapidly emerging technological trends. It therefore proposes legal reforms and policy recommendations aimed at improving the effectiveness of the NDPA to ensure that data protection keeps pace with technological advancements in Nigeria, fostering the contribution of Nigeria to the sustainable development goals across Africa.
