Data Sovereignty and Copyright Governance in the Digital Age: A Legal Pathway Towards Viksit Bharat 2047

This paper, authored by Mr. Ganesh Diriang Satarkar, Research Scholar, Central University of Haryana, critically examines the evolving landscape of copyright protection and data governance in India within the broader vision of Viksit Bharat 2047. As data becomes an essential national asset, the research explores how emerging technologies, including AI, Big Data, Cloud Computing, and Blockchain, challenge traditional copyright frameworks and demand reforms suited to the digital age. Drawing upon comparative insights—especially the European Union’s sui generis database protection regime—the paper evaluates the adequacy of India’s existing Copyright Act, 1957, in protecting databases and promoting equitable access. It further analyses India’s data protection ecosystem, including the Digital Personal Data Protection Act, 2023, and the proposed Digital India Act, with an emphasis on data sovereignty, innovation, and public interest. The study proposes a hybrid legal model integrating copyright, technological transparency, open data principles, and national security priorities. By offering a detailed policy roadmap, the paper aims to contribute to India’s journey toward a knowledge-driven and innovation-centric future Author: Mr. Ganesh Diriang Satarkar Affiliation: Central University of Haryana, Haryana, India Email: [email protected] Conference Presented At: Virtual National Seminar on “Copyright and Databases in the Digital Age: Balancing Protection, Innovation, and Access for Viksit Bharat 2047” Organised By: CIPR & DPIIT-IPR Chair, Maharashtra National Law University (MNLU), Nagpur Date of Presentation: 11 November 2025 Certificate Number: 11003 (as shown on Certificate page) Type of Work: Original unpublished academic research paper Rights: Author retains full rights; intended for academic and policy discussion

Abstract

This paper, authored by Mr. Ganesh Diriang Satarkar, Research Scholar, Central University of Haryana, critically examines the evolving landscape of copyright protection and data governance in India within the broader vision of Viksit Bharat 2047. As data becomes an essential national asset, the research explores how emerging technologies, including AI, Big Data, Cloud Computing, and Blockchain, challenge traditional copyright frameworks and demand reforms suited to the digital age.
