Linguistic inequality in migration procedures: a legal perspective on intra- and interlingual translation
Migration procedures involve multiple layers of linguistic complexity that can hinder the effective exercise of fundamental rights. This research aims to examine how linguistic inequality shapes the accessibility of state communication in migration law. Focusing on the legal framework governing language use and on return decisions as a case study, it seeks to explore how inter- and intralingual diversity affects migrants’ understanding and ability to act upon their rights. Ultimately, this study aims to critically assess legal standards and practices concerning multilingualism and clarity of communication in migration law. It also seeks to recognise the central role of linguistic clarity in ensuring procedural fairness and equal access to justice, and contribute to the emerging interdisciplinary field of law and linguistics.
