Responsibility and Conscious Will Reform – A Proposal for Graded Legal and Ethical Accountability (ENG + FR)
This teaching document explores a structural reform of modern criminal law through the lens of consciousness and mental health. It argues that the current binary distinction between “responsible” and “not responsible” fails to reflect the complex interplay between mental disorder, intention, and moral agency. Zero Silent proposes a new framework of graded responsibility based on three levels of psychic discernment and introduces the concept of conscious will — the human capacity to act intentionally, even under psychological strain. The document integrates philosophical reasoning, ethical analysis, and legal reform. It calls for the creation of an interdisciplinary panel combining judges, psychiatrists, psychologists, philosophers, and civil representatives to evaluate each case holistically. Rather than opposing justice and care, the proposal bridges them — acknowledging suffering without erasing accountability, and restoring justice as a living, humane process
