EU Migration Law and Forced Displacement: A Review of Legal Changes and International Compliance
This paper examines the evolution of the European Union’s legal approach to forced migration, with a particular focus on how recent crises such as the Syrian civil war and the Russian invasion of Ukraine have exposed disparities in asylum policies. It reviews key academic contributions on the foundations and development of EU asylum law, highlighting how legal frameworks and policy shifts interact with international human rights obligations. The discussion assesses the extent to which EU asylum measures align with international legal standards, while also identifying persistent gaps, especially in the uneven treatment of refugees and the legal uncertainty surrounding EU migration policies. By synthesizing scholarly debates and pointing to unresolved issues, the paper provides a critical perspective on the challenges of constructing a coherent and rights-based EU asylum regime.
