LEGAL PROTECTION FOR FLOOD VICTIMS IN THE SPECIAL CAPITAL REGION OF JAKARTA (A STUDY COURT DECISIONS IN FLOOD CASES IN JAKARTA)

Flooding is one of the most frequent natural disasters in the Special Capital Region of Jakarta, causing significant material and immaterial losses to the affected communities. This research aims to analyze the legal protection mechanisms for flood victims based on Law Number 24 of 2007 concerning Disaster Management, and to examine the legal considerations of judges in deciding citizen lawsuit related to floods, particularly through case studies of Decision Number 205/G/TF/2021/PTUN.JKT. This study employs a normative legal research method using statutory suboptimal, both in terms of regulatory framework and practical implementation. Although Law No. 24 of 2007 guarantees the rights of victim, challenges persist in providing adequate compensation, including the lack of concrete evidence in lawsuits and the limited scope of governmental liability as stipulated in supporting regulations. Court decisions that deny compensation despite partially granting the claims reflect existing legal loopholes and highlight the need to strengthen the legal protection system for disaster victims. Therefore, policy and regulatory improvements are necessary to endure that legal enforcement is more victim centered and that government accountability in disaster management is enhanced.
