Kilka uwag o domniemaniu stosunku pracy pracowników platformowych w kontekście implementacji dyrektywy „platformowej”

This article examines selected issues concerning the presumption of employment for platform workers, relevant to the implementation of Directive 2024/2831 on improving working conditions in platform work and the achievement of its objectives. The text presents the legislative process in the context of the evolution of the assumptions regarding the development of the presumption of employment for platform workers (1) as a starting point for an analysis of the legislator’s discretion in shaping national law (2). The subject of consideration is, firstly, the obligation to “take into account the case law of the Court of Justice” (2.a.), and secondly, the obligation to respect the effectiveness (effet utile) of the directive (2.b.). Furthermore, in the context of the directive’s objective, attention is drawn to the problem of determining the legislation applicable to the presumption of an employment relationship in cross‑border platform work situations (3).
