ARTIFICIAL INTELLIGENCE IN THE RESOLUTION OF LEGAL DISPUTES: THE CASE OF THE EUROPEAN UNION AND TURKEY
The rapid advancement of artificial intelligence (AI) technologies is profoundly reshaping the legal domain and assuming an increasingly critical role in the administration of justice. As a field situated at the intersection of law, ethics, and technological innovation, AI law encompasses the regulatory, normative, and policy frameworks governing the development, deployment, and oversight of AI systems. It aims to ensure that emerging technologies operate within legal and ethical boundaries, thereby contributing to the establishment of a fair, transparent, and secure AI ecosystem. This evolving legal discipline not only fosters efficiency and innovation but also facilitates the emergence of new legal paradigms and ethical standards on a global scale. Both Turkey and the European Union (EU) are progressively integrating AI into their judicial architectures, where it serves to streamline procedural workflows and enhance the accuracy of legal decision-making. AI tools are employed across various functions, ranging from case file analysis to predictive adjudication. In recent years, AI-driven mechanisms have begun to offer novel pathways in dispute resolution, with the potential to transform the efficacy and accessibility of justice systems in both jurisdictions. These technologies promise to expedite proceedings, reduce litigation costs, and promote greater impartiality in adjudication. Furthermore, the digitization of dispute resolution processes adds a modern dimension to legal infrastructures, contributing to systemic modernization and reform. Despite adopting different regulatory strategies, both the EU and Turkey encounter parallel challenges in the integration of AI into their legal systems. These include the delineation of ethical and legal responsibility, ensuring algorithmic transparency and accountability, and safeguarding data privacy. Consequently, comprehensive regulatory frameworks and continuous oversight are imperative to align AI applications with fundamental principles of justice and the rule of law.
