Role of Judiciary in Protection of Human Rights in Pakistan
This study contributes to the existing body of literature by examining the evolving role of the judiciary in the protection of human rights with a particular focus on Pakistan. While previous scholarship has often highlighted constitutional guarantees, this research bridges the gap between theoretical provisions and their practical enforcement through judicial interpretation and activism. By analyzing key case laws, the study demonstrates how superior courts have shaped the protection of both civil, political and socio economic rights. It also explores the relationship between judicial independence and effective human rights enforcement, offering insights into the challenges of implementation in a developing legal system. Furthermore, by incorporating comparative perspectives from other jurisdictions, the research enriches the global discourse on human rights protection through judicial mechanisms. Ultimately, the paper extends the literature by not only documenting the judiciary’s contributions but also by suggesting policy oriented recommendations to strengthen the judicial role in safeguarding fundamental freedoms.
