Legal Frameworks for Promoting Reuse of Construction and Demolition Wastes and Sustainable Development

India’s growing construction industry has significantly increased the demand for building materials, resulting in a corresponding rise in construction and demolition (C&D) waste generation. Despite this, the absence of a standardized and reliable methodology for estimating C&D waste has posed challenges to its effective management. In response, the Indian government introduced the C&D waste management rules in 2016 to address these issues. This research aims to analyze the existing regulatory framework and challenges surrounding C&D waste management in India, comparing it with global models from Germany, Singapore, and the USA. The study also seeks to promote the adoption of recycled products made from C&D waste and establish incentive policies to stimulate the C&D waste recycling industry. The findings suggest that introducing tax relaxations for recycling plants and incorporating subsidy and tax policies into the industry can significantly improve the economic viability of recycled products. Furthermore, international collaboration and knowledge sharing can enhance India’s approach to C&D waste management. By adopting measures such as recognizing the circular economy potential of C&D waste materials (CEPCDR), promoting CEPCDR measurement research, and standardizing C&D waste products, India can improve its circular economy potential and sustainable management of C&D waste. This holistic and collaborative approach, drawing from global experiences while considering local contexts, can pave the way for effective C&D waste management in India.
