Legal Aspects of BIM and Civil Law across Different Jurisdictions
Building information modeling (BIM) has transformed methods in the construction industry, with a majority of the scientific literature concentrating on the technological influence of digital tools, such as electronic modeling systems specific to building information management. However, recently, the legal implications of BIM have been examined because its application notably affects contract law. Despite this, the literature regarding the case law interpretations of BIM are lacking. Specifically, while the EU has encouraged member states to incorporate electronic tools in public procurement for the construction sector, an examination of national case law is fundamental because it can fill the eventual legislative gap. This paper, with a primary focus on civil law issues, first explores the EU’s jurisdiction over BIM legal frameworks and subsequently examines the implications of BIM on civil relationships within BIM contracts through a case law study.
