Оцінювання вартості комп’ютерних програм, створених як службові твори для використання у структурних підрозділах системи Міністерства оборони України

Currently, there is a growing demand for mission-critical software (SW) within the system of the Ministry of Defense (MoD) of Ukraine, particularly for: automated command and control systems (C2), integrated with NATO (e.g., Delta); cybersecurity tools (detection, attack prevention, antivirus solutions); and artificial intelligence (AI) systems for intelligence analysis (satellite imagery, signal interception). The Russian aggression against Ukraine has significantly altered the requirements for defense software, highlighting the need to account for the cost of adapting to new threats (electronic warfare, drones, EW), as well as the uncertainty of the software life cycle, which may require rapid updates. The development of a methodological approach to the evaluation of computer programs created within the MoD of Ukraine as official works is an important task for ensuring proper legal and economic regulation in the field of intellectual property, especially under wartime conditions with the Russian Federation. An analysis of evaluation methods for computer programs created within the Ministry of Defense of Ukraine as official works has been conducted. SWOT analysis revealed the strengths of existing methods and made it possible to propose combined approaches that can be recommended for evaluation of computer programs (software) in the MoD of Ukraine, depending on the purpose of the evaluation. The analysis of the considered methods led to the conclusion that selective application and reasonable combination of these methods are necessary, taking into account the intended use of the evaluation results.
