The anatomy of privacy: Guernsey’s relationship with justice, transparency and trust confidentiality
Abstract In In the Matter of the B Trust (Royal Court, Unreported) [2025] GRC 0002, the Royal Court of Guernsey demonstrated its evolving approach to privacy applications. This note explores the delicate balance between transparency and confidentiality in Guernsey trust litigation. It considers the significance of the “strict necessity” test when determining privacy applications and the Court’s focus on protecting beneficiaries’ interests. The judgment illustrates the Court’s continuing and unwavering commitment to open justice principles, public confidence and integrity in their proceedings, whilst acknowledging exceptions where justice would otherwise be frustrated.
