Legal Framework and Community Participation in Reserve Forests: A Study of Uttarakhand

This paper explores the legal framework and community participation in the governance of forest reserves in Uttarakhand. Forests in the region are central to rural livelihoods, providing critical resources such as fodder, fuelwood, and non-timber forest products. Over time, legislations such as the Indian Forest Act (1927), Wildlife Protection Act (1972), Forest Rights Act (2006), and the Biological Diversity Act (2002) have shaped access and conservation practices, often creating tensions between statutory controls and traditional rights. Local institutions like Van Panchayats, historically central to community-led forest governance, now face challenges due to legal restrictions, bureaucratic oversight, and external pressures from tourism and industrial activity. Methodologically, the study employs a qualitative research design, combining doctrinal legal analysis with field-based case studies of Uttarakhand Forest Reserves. Data sources include review of policy documents, government reports, and scholarly literature. The findings indicate that while participatory models such as Joint Forest Management and Biodiversity Management Committees have created avenues for community involvement, challenges of inadequate implementation, conflicting legal provisions, and unregulated tourism remain. The paper argues that sustainable forest governance in Uttarakhand requires a more integrated approach that strengthens legal mechanisms while ensuring genuine community participation in decision-making.
