Miễn trừ truy tố đối với nhân chứng theo pháp luật tố tụng hình sự Hoa Kỳ và kinh nghiệm cho Việt Nam
Under the United States’ law, in case a witness refuses, on the basis of his privilege against self-incrimination, to testify, but his testimony is necessary and irreplaceable for solving the case, then the witness may receive immunity from prosecution in exchange for valuable testimony. To balance with the interests of the public, restrictions on the use of witness immunity are designed, and the scope of its application also is a concern. This article explores witness immunity under United States criminal procedure law. On that basis, the authors propose recommendations to enhance Vietnamese criminal procedure law on relevant issues.
