The Rise of Cyber Crime: Evaluating the Effectiveness of the Current Legal System
Abstract As digital technology continues to evolve, the incidence of cybercrime escalates, posing significant challenges to personal and national security. This research critically examines the legal and institutional frameworks established in India to combat cyber threats. Key legislative acts such as the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and the recently implemented Bharatiya Nyaya Sanhita (BNS), Bharatiya Nagarik Suraksha Sanhita (BNSS), and Bharatiya Sakshya Adhiniyam (BSA) are analysed for their relevance and adequacy. The paper also compares India’s legal infrastructure to international standards and highlights enforcement challenges. By identifying legislative gaps and proposing reforms, this paper aims to contribute to building a safer digital environment in India.
