Політико-правові погляди Лева Ребета про місце і роль території як важливої ознаки держави

The article is devoted to the study of the political and legal views of Lev Rebet on the place and role of territory as an important feature of the state. It is noted that in modern jurisprudence, territory is one of the key features of the state, which determines its physical space and material basis of existence. It covers land, internal waters, subsoil and airspace located within the state border. The territory serves as a base for the exercise of state power and the extension of sovereignty to the population living in this territory. The territory of the state constitutes a necessary, and in most cases sufficient material operational base for its very emergence, existence and development. The territory is a certain planar capacity that holds all the objects of the state: from natural resources to human homes. And the very birth of the state is possible only after the separation of a certain territory, which is a rather complex process. On the territory of the state, a complex combination of the most diverse objects inevitably occurs, which begin to act as a single organism. Within its territory, the state exercises territorial supremacy (i.e., the highest and exclusive power), which is an organic part of state sovereignty. It is emphasized that territory is an important attribute and sign of statehood. A significant contribution to revealing the role and place of territory in the history of the nation (people), society, state, determining the importance of territory as an important sign of the nation was made by Lev Rebet – an outstanding Ukrainian politician, Doctor of Law, Professor of the Ukrainian Free University, theorist of the nation, editor and publicist, lawyer, one of the leaders of the OUN. In his work «Theory of the Nation», the scientist emphasized that land, territory, space are one of the first factors that ensure the survival of a group. The value of land is so strong that until now a permanent place of residence in one territory determines state affiliation, with which national affiliation generally goes. L. Rebet tried to determine the place and role of the territory in the history of the nation and its state. He rightly notes that coexistence in one space creates common experiences, common consciousness and common aspirations. It preserves and nurtures them. The land determines meetings and rapprochement: neighborhood, marriage, gatherings, hikes and all other possible forms of coexistence. At the same time, sensual experience separates it from specific conditions and places it outside of time and space. However, the basis of this sublimation is real relations in the designated space. Emigrants, scattered around the world, live a national life, as they continue to cherish the traditions of the homeland and do not cease to treat it as the basis of their inner being.
