Співвідношення функцій місцевого самоврядування з функціями держави

The article is devoted to the issues of the correlation of the functions of local self-government and the functions of the state. Attention is drawn to changes in the scope of the state’s influence on local self-government associated with the transformation of the territorial organization of local government, decentralization processes and deconcentration of state powers. It is noted that powers are mediated by the tasks and functions facing the state and local self-government. Attention is focused on the fact that in the modern period the state is a social public institution that ensures the integrity, management and development of society in the process of implementing its functions and is significantly different from previous ideas about the state. During the analysis of legal sources, the concepts of the functions of local self-government and the functions of the modern state were identified, which will be used in the work. It was found that it is the purpose of the state or local self-government that determines the main tasks (issues that need to be resolved in the process of implementing the functions of the state) facing them. At the same time, the main parameters of such tasks, as well as functions, in modern states are fixed at the level of constitutions or laws, therefore they are objective in nature. It has been established that the appropriate criterion for identifying the functions of the state and local self-government are the tasks that are fixed in constitutional and legislative provisions. Attention is focused on Article 143 of the Constitution of Ukraine, which enshrines the main tasks of local self-government, the solution of which will contribute to achieving the goal of its functioning. These tasks are specified in legislative provisions, the analysis of which shows that they, like the tasks of the state, are aimed at ensuring integrity, management and development within the relevant territorial communities and take place in various spheres of life. It is emphasized that the functions of local self-government are not identical to the functions of the state, but are formed from the angle of the interests of territorial communities and their coordination with the interests of the state.
