Análisis jurídico sobre la revisión de sanciones en casos de violencia de adolescentes infractores
The article “Analysis of the increase of sanctions to adolescent offenders in Ecuador” examines in a comprehensive way the problem of juvenile justice in the country, from a legal, social and economic perspective. The research is based on a qualitative approach, using key methods that will help us to review the Code of Childhood and Adolescence, evaluating the proportionality of sanctions, their rehabilitative purpose and the prevention of recidivism. Regulatory gaps are identified that hinder the effective application of a restorative model, proposing reforms that strengthen the rights and guarantees of adolescents in conflict with the law. From a social point of view, an analysis is made of how the increase in youth violence affects social cohesion, family structure and the perception of citizen security. The involvement of adolescents in gangs reveals failures in the transmission of values and the weakness of current socio-educational measures. In the economic sphere, it is recognized that the contexts of structural poverty and family disintegration have a direct influence on juvenile criminal behavior. The normalization of violence in vulnerable environments generates an intergenerational reproduction of crime, which calls for comprehensive, preventive and sustained state intervention. Therefore, the study highlights the need for a multidisciplinary approach to juvenile justice that combines proportional punishment with rehabilitation and reintegration measures, guaranteeing the rights of adolescents and promoting a more effective state response to juvenile delinquency in Ecuador.
