The unspeakable and the yet to be said. For a policy of restitution of property and memory
Benjamin spoke of a truth in the name. A truth that the name speaks. A silent truth that nevertheless, almost at the edge of the story, speaks. How can we materialize in legal texts that what is incapable of inscribing speech itself? This article attempts to address the question of the unspeakable in the legal scene from a double register: the fainting of the witness Dinur in the Eichmann trial and the still unpunished massacre of Jedwabne. Within the framework of this gap, a policy of restitution of property and memory as a locus of enunciation is advocated
