A Retrospective Analysis and Problematic Issues of Legal Regulation of the Appointment and Application of Punishment in the Form of Life Imprisonment

the article, taking into account changes in the current Russian criminal legislation and the provisions of the legislation of individual CIS countries, the opinions of researchers, examines issues of legal regulation of the appointment and application of punishment in the form of life imprisonment. A retrospective analysis of criminal legislation and the practice of its application is characterized by trends towards an increase in the number of crimes, the sanction for the commission of which contains life imprisonment and a restriction on the right to release from serving this punishment. The author comes to the conclusion that at the present stage, a separate type of life imprisonment without the possibility of parole is distinguished in the Russian criminal law. At the same time, the existing legal regulation and practice of applying the legislation hinder the implementation of certain areas of probation in relation to persons sentenced to life.
