TO THE QUESTION OF DETERMINING THE LEGAL NATURE OF DIGITAL PERSONALITY

Existing normative legal acts regulate relations that initially appeared within the real world, and they are often unable to take into account the specifics of relations in the virtual space. In this scientific work, individual issues of determining the place of a digital personality in the legal space are considered as the subject of research. Questions are raised about determining the existence of such a concept as digital life, then whether a digital personality exists and whether it has rights, and if so, what are they. The issue of the scope of the concept of the subject of the right to digital life is revealed. The purpose of the study is to qualify the digital personality. The processes occurring in the digital world, which are only a continuation of real life offline, are studied, and the right to digital life is possessed by the subject of traditional law. The scientific value of the study lies in the fact that to date there is no legal definition of a digital personality and its comprehensive legal regulation. This work has both theoretical and practical significance in the formation of legal regulation of digital personality. The work concludes that the creation and development of the doctrine and legal regulation of digital personalities will depend entirely on the position that the legislator takes regarding artificial intelligence.
