Independencia de los jueces e independencia del Judicial en la Unión Europea
The work analyzes the jurisprudential evolution of the independence concept. Although the guarantee was traditionally approached from an individual perspective - in relation to the judge who had to dispense the specific judicial protection -, the proliferation of populism in some Member States, and the reforms aimed at eliminating it, led to a more “a priori” and structural approach in which the national judges’ independence is presupposed by the independence of the Judiciary itself.
