El Derecho a la Resistencia en el Ordenamiento Jurídico Ecuatoriano, Análisis de su Reconocimiento Constitucional y sus Vicisitudes Normativas
This research undertakes an in-depth analysis of the right to resistance, enshrined in Article 98 of the Constitution of the Republic of Ecuador. Despite being incorporated into the catalog of rights in the Supreme Law, this right lacks normative or jurisprudential development that delimits its scope and, above all, its exercise. This omission by the legislature creates a legal vacuum that limits its factual and practical applicability, placing citizens in a state of legal uncertainty. The research therefore reflects on the risks of maintaining a constitutional norm without an infra-constitutional development that guarantees its effective application in a state of rights and justice.
