La Adopción eficaz para neonatos, infantes y adolescentes con discapacidad en Ecuador: Effective Adoption for Newborns, Infants, and Adolescents with Disabilities in Ecuador

Adoption in Ecuador takes the form of a special protection mechanism aimed at guaranteeing the right of children and adolescents to live in a family, in conditions of affection, dignity, and stability. The following article presents a critical and proactive analysis of the Ecuadorian legal system in the area of adoption, particularly in relation to the obstacles encountered by newborns, infants, and adolescents with disabilities. Using a qualitative approach that combines a review of regulations, doctrine and jurisprudence, and opinion surveys among the country's legal experts, the article examines the real need to amend Articles 190, 191, 192, and 193 of the Organic Code on Children and Adolescents in order to establish expeditious processes that offer guarantees and are sensitive to the constitutional principles of the best interests of the child and favorability. It is vital that rapid, priority and differentiated adoption for minors with disabilities is not only legally viable, but is also constitutionally mandatory, generating a public policy of social justice and restitution of rights for a historically invisible group.
