Los litigios civiles transnacionales europeos: trascendiendo la diligencia debida empresarial

Tort liability is a key avenue for claiming compensation for damages caused by companies, either through direct or indirect liability along their chains of activity. In this paper, we start from the idea that the new European regulatory framework on corporate due diligence, while providing procedural improvements in transnational litigation, cannot, by itself, guarantee true access to the courts. In order to guarantee this access, it is necessary to modify, make more flexible and specialize the instruments of Private International Law.
