La gobernanza colectiva de la seguridad y salud en el trabajo

This article examines the impact of the commitments made by the social partners who signed the Fifth Agreement for Employment and Collective Bargaining on occupational health and safety. It presents a critical analysis of all national sectoral collective agreements published in 2024 and a sample of company-level agreements, identifying which issues have not been sufficiently addressed and the aspects that require greater attention from the negotiating tables, thereby enriching the content of future agreements. The study then focuses on evaluating the clauses that contribute to generating a preventive culture in companies and among workers, as well as those that provide tools for the assessment and combat of psychosocial risks, particularly stress and psychological harassment. It concludes by assessing the extent to which collective autonomy has fulfilled the expected role of complementing and improving occupational risk prevention legislation.
