Independencia judicial y proceso penal europeo: el derecho a un juez independiente y su incidencia en el espacio de libertad, seguridad y justicia
Without independent judges, Member States cannot establish the necessary remedies to ensure effective judicial protection in the areas covered by EU law, as required by Art. 19(1)(II) TEU. The CJEU links the guarantee of judicial independence to the fundamental right to a fair trial in Art. 47(II) CFREU. This requirement of independence is of paramount importance as a guarantor of the protection of all the rights conferred on citizens by the Union's legal order, with far-reaching implications for the AFSJ, and for the safeguarding of the common values of the Member States proclaimed in Art. 2 TEU.
