After Law 8/2021, the principles proclaimed by the 2006 New York Convention on Persons with Disabilities are collected and embodied, including the principle of autonomy, which accentuates the person’s leading role in their own decision-making process, and the principle of subsidiarity, which consists of not admitting any form of judicial support when the person has adopted the necessary measures and decisions to order their own support. In any case, the measures adopted by the judge in the procedure for the provision of support, which will be exceptional, must be proportionate to the needs of the person who needs them, must respect the maximum autonomy of the latter in the exercise of his or her legal capacity and must in all cases attend to his or her will, wishes and preferences.
