Gaza, Israel, and Just War Theory
This thesis critically examines Per Bauhn's defense of Israel's military actions in Gaza, as presented in his article "Just war, human shields, and the 2023–2024 Gaza War". Using the framework of just war theory, the study analyzes Bauhn's arguments regarding Israel's jus ad bellum and jus in bello claims. The analysis reveals significant empirical and logical weaknesses in Bauhn’s defense, particularly regarding Israel’s justification for war, adherence to principles of proportionality and distinction, and the portrayal of Hamas as an existential threat. By evaluating his arguments, the study concludes that Bauhn's article fails to demonstrate the moral legitimacy of Israel's actions in Gaza under just war theory.
