The right to access to justice constitutes an essential condition of the rule of law and a international minimum standard. This article seeks to highlight the current imbalance between foreign investors, especially transnational compa­nies, and those affected by their activities, regarding the access to justice at foreign investment law and international human rights law was developed. Both international and national case law and arbitration practice on investment matters constituted an important source of analysis.
