Техніко-технологічні аспекти прийняття та реалізації локальних нормативно-правових актів місцевого самоврядування
This article is dedicated to the consideration of problematic issues related to the legal regulation of the process of developing normative-legal acts of local self-government in Ukraine. The key stages of the process are analyzed, including the preparation of draft acts, their coordination, and publication, as well as the interaction with executive authorities and the public. Based on the study of problematic issues, the main drawbacks of the legislative regulation include gaps, the absence of unified rules and requirements for the process and draft acts, as well as the diversity of regulatory norms in the field of municipal lawmaking. The article provides recommendations for improving procedures aimed at enhancing the quality and efficiency of the adoption of normative-legal acts at the local level. Adherence to the requirements for the drafts of local normative-legal acts of local self-government, as well as compliance with general and specific principles during the development of these acts, involves taking into account the features and needs of the socio-economic development of a specific community or region, as well as addressing the interests of different segments of the population of the relevant administrative-territorial unit. The absence of unified rule-drafting guidelines and requirements for the procedure of developing normative-legal acts of local self-government, as well as the documentation of the draft acts, leads to violations of the requirements of the law-making process as a whole. This not only hinders the creation of high-quality and effective normative-legal acts of local self-government, but also significantly reduces the real opportunities for the effective and timely resolution of local issues by territorial communities, either directly or through local self-government bodies and officials. In the conditions of the European integration processes, issues related to the development and adoption of scientifically based, balanced legal decisions acquire primary importance. It is, first of all, about the implementation of rule-making activities by specially authorized entities within the limits of competence and in the established procedural and procedural forms. aking into account Ukraine’s commitment to the formation of a legal social democratic state, which provides for the establishment of the principle of the rule of law as the basis of the organization and activities of public authorities, hat is, the priority of the rights and freedoms of a person and a citizen, any decision (of a state authority or local self-government body) should not simply provide for the achievement of a predetermined goal, but be aimed at ensuring the effectiveness of legal regulation in general.
