Корупційна злочинність: основні аспекти її кримінологічної характеристики
The article is devoted to highlighting the essence and content of the criminological characteristics of corruption crime. Issues related to the content of the signs of corruption crime and its correlation with corruption criminal offenses are analyzed. The author emphasizes that corruption crime as a historically variable, relatively massive, stable, self-determining, systemic-structural, socially negative phenomenon is most clearly manifested in corruption criminal offenses. However, corruption crime is not identified with the arithmetic sum of corruption crimes, since it additionally has features that give it special properties of a negative social phenomenon. The article also draws attention to the fact that, unlike corruption criminal offenses, corruption crime is characterized by self-determination. Corruption creates the conditions for its reproduction due to the fact that it negatively affects the future socio-economic and political order in the state. At the same time, the longer the period of large-scale corruption, the more problematic it will be to counteract corruption crime and eliminate its consequences. In the article, the author also emphasizes that the criminological characteristics of crime do not take into account the personality of the criminal, however the analysis of this issue, in terms of the criminological characteristics of corruption crime, will complement and deepen the analysis of this phenomenon and is one of the aspects of the analysis of the level of corruption crime. Regarding the characteristics of a corrupt person, it is necessary to focus on the current criminal legislation, in particular, considering who the legislator considers to be the subjects of corruption criminal offenses. The legislator divides corruption criminal offenses into two groups, which at the same time affects the definition of their subject.
