Проблеми влаштування дітей з інвалідністю в сімейні форми виховання
The article examines the current state of legal regulation of the placement of children in family forms of upbringing in Ukraine, including children with disabilities. Ukrainian legislation and international norms are analyzed, in particular the UN Convention on the Rights of the Child, which determines the priority of the best interests of the child when making any decisions regarding his or her future. Attention is paid to the issues of immediate removal of children in case of threat to their life and health, as well as the choice of further form of their placement. The advantages of family-based forms of upbringing, such as foster families, family-type orphanages, and temporary placement with the family of the actual caregiver, are investigated. Key aspects of their impact on the emotional, social, and personal development of the child are identified. The difficulties of placing children with disabilities were separately analyzed, including problems of inclusive education, social adaptation and physical accessibility, low level of adaptation of state institutions, and problems of legal regulation. Systemic problems have been identified that hinder the effective placement of children with disabilities in a family environment, including insufficient state support, a limited number of foster families and family-type orphanages, and a low level of specialist training. Key aspects that require improvement have been identified, including a comprehensive interagency approach, strengthening social and material support for families, developing inclusive education, and adapting legislation. Measures have been proposed to improve the conditions for raising children with disabilities in family forms of upbringing, which will contribute to their successful socialization and realization of rights. The author concludes that the placement of children with disabilities is important because it contributes to their harmonious development, socialization and self-realization. Inclusive education provides equal opportunities for all children, helps them develop the skills necessary for future life, and contributes to a tolerant society. Proper support for such children allows them to reach their potential, receive a quality education, and integrate into society, and a key aspect of all this is the child’s stay in family forms of upbringing. Thus, ensuring appropriate conditions for children with disabilities is not only a matter of justice, but also an important step towards creating an inclusive society.
