Огляд місця події при розслідуванні злочинів проти життя та здоров’я особи, учинених членами молодіжних неформальних груп (об’єднань)
The article emphasizes that a crime scene inspection is a primary investigative (detective) action that is carried out when investigating crimes against the life and health of a person committed by members of informal youth groups (associations). According to the general provisions of forensic tactics, the process of conducting a scene inspection when investigating crimes against the life and health of a person committed by members of informal youth groups (associations) consists of two key stages: 1) preparation for conducting a scene inspection and 2) cognitive inspection activities (direct inspection). Preparatory actions before going to the scene of the crime of the specified category are as follows: 1) the investigator (prosecutor) must clarify the nature of the incident in accordance with the received report; 2) taking measures to protect the scene of the incident and provide assistance to the victims (with the involvement of officers of the National Police of Ukraine); 3) ensuring the safety of citizens in areas bordering the scene of the incident; 4) determine the forensic technique that will be used (or may be used); 5) determine the composition of the group (circle of people) that will participate in the inspection of the scene (it is mandatory to involve a specialist who studies the formation and activities of informal youth groups (associations, movements, ) in the inspection, and in his absence – a specialist in cultural studies); 6) determine the number and types of vehicles necessary to organize the specified investigative (search) action; 7) organize the procedural formalities for conducting an inspection of the scene of the incident at the preparation stage. Upon arrival at the scene of the incident, the investigator (prosecutor) must: 1) lead the inspection of the scene, have a flexible plan and constantly adjust it; 2) determine the number of victims and make sure that they are provided with assistance (it is imperative to pay attention to the external signs, clothing, and jewelry of the victims); 3) interview eyewitnesses; 4) remove unauthorized persons from the scene; 5) identify and prepare special technical means that will be used (investigator’s equipment); 6) instruct operational officers of the National Police units to conduct other investigative (search) actions (for example, interrogation of witnesses). The stage of direct inspection of the scene of the incident (working stage) in the investigation of crimes against the life and health of a person committed by members of informal youth groups (associations) begins immediately after the completion of all preparatory actions. The practice of investigating crimes against the life and health of a person committed by members of informal youth groups (associations) shows that in most cases the criminal event has a center, and therefore it is advisable to use an eccentric method of review (from the center to the periphery). Examination of the scene of the crime when investigating crimes against the life and health of a person committed by members of informal youth groups (associations) is the main information-seeking investigative (search) action that determines the further course of the investigation and serves as the basis for putting forward investigative versions.
