Проблемні питання виявлення та притягнення до відповідальності осіб призивного віку: адміністративно-правовий аспект

The current situation with regard to mobilization in Ukraine is such that it requires additional legal and regulatory regulation due to the fact that there are gaps in the mobilization process itself between representatives of law enforcement agencies, such as the State Border Guard Service of Ukraine and Territorial Centers for Recruitment and Social Support. Citizens of Ukraine of conscription age who are subject to mobilization between the ages of 18 and 60 are trying to get to Western Europe or North America by legal and illegal means to avoid military service in Ukraine. With regard to the control over persons liable for military service, the current legislation stipulates that male citizens of Ukraine aged 18 to 60 are required to carry a military registration document and present it at the request of an authorized representative of a territorial recruitment and social support center (hereinafter referred to as the “TSC and SS”) or a police officer, as well as a representative of the State Border Guard Service of Ukraine in the border area, controlled border area and at checkpoints across the state border of Ukraine. At the same time, the law does not regulate the further procedure for the actions of representatives of the State Border Guard Service of Ukraine. The research materials are: 1) regulatory and legal support on the procedure for interaction between representatives of the territorial center for recruitment and social support, the National Police and the State Border Guard Service of Ukraine on mobilization issues; 2) works of domestic scholars on mobilization in Ukraine. The study used the method of theoretical generalization and grouping (to characterize the process of interaction between representatives of the territorial center for recruitment and social support, the National Police and the State Border Guard Service of Ukraine on mobilization issues); the method of analysis and synthesis (to build a reflection of the process of interaction between representatives of the territorial center for recruitment and social support, the National Police and the State Border Guard Service of Ukraine on mobilization issues). The article highlights a gap in the current legislation on the procedure for interaction between representatives of the territorial center for recruitment and social support, the National Police and the State Border Guard Service of Ukraine on mobilization issues. The author proposes changes to the regulatory framework to regulate this process and prospects for further research on this issue.
