Захист прав дітей на охорону здоров’я в умовах збройного конфлікту: національний та міжнародно-правовий аспекти
The article examines the realization of children’s right to health care during wartime, highlighting the key challenges posed by armed conflict. These challenges include restricted access to medical services, destruction of healthcare infrastructure, and increased psychosocial burdens on children affected by war. The study analyzes Ukrainian legislation in the field of children’s health care and its alignment with international standards, particularly the provisions of the UN Convention on the Rights of the Child. Emphasis is placed on the principle of the best interests of the child, which serves as a cornerstone in ensuring individualized approaches to medical care, especially during crises. Also focus is devoted to mechanisms for implementing this principle, such as assessing the maturity of children when making medical decisions, adapting healthcare policies to crisis conditions, and integrating psychosocial support for children suffering from trauma. Furthermore, the financial dimension of healthcare programs for children is critically analyzed, with particular attention to the need for increased funding and efficient resource allocation. The article also explores best practices from European Union member states regarding healthcare protection for vulnerable populations and discusses their potential adaptation in Ukraine. Recommendations are proposed for harmonizing national legislation with international legal frameworks, such as the European Convention on Human Rights. This alignment is viewed as crucial for addressing gaps in the current regulatory framework and for ensuring comprehensive protection of children’s rights to health care. The findings of the study are expected to contribute to the development of effective policies and practical measures aimed at safeguarding children’s health during crises. By integrating international standards and fostering cooperation between governmental and non-governmental organizations, Ukraine can enhance the resilience of its healthcare system and ensure the protection of the most vulnerable population – its children.
