Генеза розвитку наукової доктрини про державний суверенітет

The article determines the relevance of the study of the scientific doctrine on the historical development of the category of “State sovereignty” as a particularly important issue in the context of our country’s countering military hostile aggression and implementation of public administration in the country under the declared legal regime of martial law. The author examines the category of state sovereignty at the internal level as a state of unity, indivisibility and independence of state power in the country and at the external level as independence and equality of the state in interstate relations with other countries. The author reveals the content of key scientific issues on the impact on sovereignty of the legitimization of state power in the context of characterizing its public administration essence and features of its implementation. The author examines the genesis of the problem of the formation of state power in different periods of society’s development. In particular: the embodiment of sovereignty in the person of the monarch as a natural and inalienable right to supreme power; contrasting the doctrine of legitimism, for which the key issue was the justification of the right to power, with the doctrine of legitimation, which is centered around the problem of ensuring that the exercise of state power is in line with the sovereign will of the people. The author generalizes that sovereignty as a complex legal phenomenon means the full power of the state on its territory, as well as the ability to independently make legislative decisions on domestic and foreign policy without influence from other states, international or intergovernmental organizations, individuals, etc. Human rights set the scale for the legitimacy of state power and the functional purpose of the latter – to ensure state sovereignty as a space for the affirmation of the dignity of the human person on the basis of mutual respect, freedom and liberty. It seems promising for further scientific and legal comprehension of the representatives of modern administrative and legal science to find ways to improve the administrative relations of sovereignty as a socio-political category in the concept of legal regulation of democracy relations.
