Правове регулювання служби в органах місцевого самоврядування на прикладі Німеччини та Великобританії
The article presents the results of a study of the experience of individual European countries (Germany and Great Britain) in terms of legal regulation of service in local government bodies, and also substantiates proposals for improving Ukrainian legislation in this area, taking into account the European experience of such countries. The development of the latest legislative regulation of service in local government bodies is closely related to taking into account the experience of foreign states, primarily the EU member states. According to the results of the analysis of supranational European legislation, namely the European Charter of Local Self-Government, the Helsinki Declaration of Regional Self-Government, it was determined that these documents enshrine the general aspirations of the member states of the Council of Europe to provide decent working conditions for municipal employees – no worse than those provided for civil servants. The author notes the high level of social protection of municipal employees, the tendency to ensure gender equality between men and women by enshrining quotas for women in the legislation, the high level of prestige of municipal service and the development of the institution of political responsibility of elected municipal positions in Germany and Great Britain. The author supports the idea of introducing a register of interests of officials of local government bodies in Ukraine in order to avoid a conflict of interest during their stay in municipal service according to the British model. It is proposed to borrow the experience of Germany in dividing employees into full-time and honorary officials with a clear distinction between their functional powers and the regime and remuneration of labor. The emphasis is on the need to establish specific and clear requirements for conducting periodic assessment (certification) of employees at least twice a year. The article analyzes the further vector of actions for the implementation of individual provisions of the Association Agreement, and also states the low degree of harmonization of Ukrainian legislation with EU standards.
