Законність нормативно-правових актів: стан та перспективи наукового дослідження

In the content of the scientific work, the author emphasizes the relevance of the topic. It is noted that in the current conditions of full-scale aggression by Russia, a significant number of current legal norms adopted under martial law do not always meet the requirements of legality both in terms of their adoption and in terms of compliance with the norms of law enshrined in legislative acts, which necessitates a thorough doctrinal analysis of the phenomenon of their legality. The purpose of this scientific work was to analyze approaches to understanding the phenomenon of legality, to clarify the features of the legality of regulatory legal acts as a subject of scientific knowledge, and to determine the prospects for its further scientific study. In the work, the author explores the main aspects of understanding legality as a complex, multidimensional phenomenon. It is emphasized that the ambiguity and multifacetedness of understanding the phenomenon of legality in legal doctrine today determines the appropriate strategy for its further scientific development. This is due, first of all, to the importance of generalizing the various views of scientists on the issue of legality, which are substantiated in the legal literature, determining its features as a subject of modern scientific legal research. Key vectors for further scientific development of issues of legality of regulatory legal acts have been identified, which include: 1) strengthening the methodological support of scientific knowledge of legality by combining general scientific and special scientific research methods; 2) carrying out a critical analysis of the state of legal support for the legality of regulatory legal acts in Ukraine; 3) improving the definition of the concept of «legality of regulatory legal acts», distinguishing it from other related concepts; 4) isolating and substantiating the criteria for measuring the legality of regulatory legal acts, clarifying the features of the practice of their application in Ukraine; 5) substantiating from the point of view of legal doctrine practical ways to strengthen the legality of regulatory legal acts in Ukraine, etc. It is concluded that the issue of the legality of regulatory legal acts is a relevant topic for current and future research, due to the need to improve the processes of lawmaking and law enforcement, especially during martial law and in the post-war period in Ukraine.
