Правові механізми подолання екологічних наслідків військової агресії Російської Федерації проти України

The article draws attention to the fact that after the Chernobyl accident in 1996, the environmental disaster became one of the largest in the world. However, on February 24, 2024, the Russian Federation launched a full-scale military aggression against Ukraine, as a result of which the Ukrainian state suffered not only human casualties, devastating economic consequences, but also negative consequences for the environment. As a result of military actions, one of the most important environmental problems in Ukraine became air, water and soil pollution. Constant bombing and shelling of cities, settlements, front-line territories led to the release of a large number of toxic chemicals into the environment. The article analyzes the works of scientists who studied similar issues, provides statistical data on the negative consequences of the impact of war on the environment, which imposes on the state and its authorized bodies the constitutional obligation to ensure the right of every citizen to an environment safe for life and health. It is emphasized that one of the most important environmental problems during the war was also the destruction of forests and wildlife habitats, which significantly affected biological diversity. Attention is drawn to the recommendations of researchers from the World Wildlife Fund, who note what Ukraine and its partners can do to restore the environment after the war. It is emphasized that Ukraine, as a candidate country for accession to the EU, must adopt a number of norms, standards and obligations, as well as take a course towards a «Green Policy». A number of international and domestic regulatory and legal acts on the environmental policy of the state are analyzed. It is emphasized that the environmental problems of Ukraine, along with the implementation of the right to a safe environment for life and health in war conditions, as a result of which caused damage to the natural environment, violated the environmental rights of citizens, necessitate the adoption of legal mechanisms to overcome existing environmental consequences. It is concluded that overcoming the environmental consequences of the war in Ukraine requires the use of the entire complex of organizational, legal, economic, financial, scientific, technical, professional and other means by which such consequences can be overcome.
