Сучасний стан та тенденції корисливо-насильницьких злочинів, що вчиняються іноземцями у складі організованих груп в умовах збройного конфлікту в Україні

The article emphasizes that the situational complication, along with factors of a purely criminogenic nature, is largely influenced by military actions, daily rocket attacks and sabotage and subversive activities throughout the country, as well as the lack of control over part of the territory and, accordingly, the intensification of migration processes, in particular, internal displacement of the population. The author analyzed the state, structure and dynamics of mercenary and violent crimes committed by foreigners as part of organized groups in the context of the armed conflict in Ukraine. Attention is drawn to the fact that mercenary and violent crimes are placed in different sections of the Special Part of the Criminal Code of Ukraine and are reflected in statistical reporting since the introduction of modern forms of such reporting (2013). At the same time, state statistics do not contain data on such crimes committed by foreigners as part of organized groups. It was established that in the context of a general reduction in criminal activity indicators, both positive and negative trends were observed in relation to organized mercenary and violent crime with the participation of foreigners. So in 2014–2015. the number of detected organized groups and criminal organizations formed on an ethnic basis decreased, and in the following years (2016–2024) it increased almost threefold. Under martial law, there is an annual increase in the number of detected organized groups and criminal organizations formed on an ethnic basis, which distinguished themselves in group mercenary-violent crime, when committing serious and especially serious crimes with the use of weapons. Among all criminal groups of foreigners, organized groups constituted almost the absolute majority. Almost a thousand foreigners were detected, who distinguished themselves in group mercenary-violent crime, when committing serious and especially serious crimes. It is emphasized that the criminal activity of organized groups and criminal organizations with the participation of foreigners is characterized by diversity, since not single criminal-illegal acts are committed, but multiple, in several directions of profitability, using different tactics and mechanisms of commission. Another trend is the expansion of the spheres of their criminal interests, a clearer specialization of criminal activity, which is in constant dynamics, as well as professionalization, which increases the level of concealment.
