Правові та інституційні зміни в системі інтелектуальної власності України
This article provides a comprehensive analysis of legal and institutional changes in Ukraine’s intellectual property (IP) sector that took place in 2024, with a particular focus on harmonizing national legislation with international standards, including those of the European Union and the World Intellectual Property Organization (WIPO). The study examines key legislative initiatives aimed at improving the legal framework for the registration, protection, and use of intellectual property objects, as well as reforming administrative procedures to enhance their efficiency and transparency. Special attention is given to the implementation of digital technologies, including electronic protection documents, blockchain technologies for authorship verification, and the creation of a national list of web resources that violate intellectual property rights. The article explores the establishment and functioning of the Appeals Chamber of the National Intellectual Property Authority as an effective mechanism for administrative appeals against registration decisions, which helps to reduce the burden on the judicial system and ensure the prompt resolution of disputes. Particular emphasis is placed on the reinstatement of patent attorney certification, which is a crucial step in forming a highly professional environment for IP specialists in accordance with European standards. The study also analyzes the significance of Ukraine’s integration into the WIPO ALERT initiative and its impact on international cooperation in combating IP rights violations, as well as outlining the prospects for applying new technologies to enhance legal protection mechanisms. The role of European integration processes in reforming Ukraine’s intellectual property sector is highlighted, particularly the implementation of EU norms into national legislation, the improvement of IP rights protection mechanisms, and the expansion of international legal cooperation. The findings confirm that the implemented reforms contribute to increasing the efficiency of legal regulation in the field of intellectual property, adapting the legislative framework to the challenges of the digital economy, and expanding international cooperation. Further development in this area should focus on improving law enforcement practices, integrating innovative technologies, and strengthening the institutional capacity of bodies responsible for IP protection in Ukraine.
