With the increase in the use of social networks, especially after the COVID-19 pandemic, the dissemination of information, often untrue and controversial, has intensified. This ar-ticle analyzes the debates on the regulation of these platforms, addressing arguments for and against. The right to freedom of expression and information, guaranteed by the Fede-ral Constitution of 1988, is confronted with the need to curb hate speech and narratives harmful to democracy. The methodology was based on a literature review and deductive analysis, starting from general concepts to specific discussions about the impact of social media in the Brazilian political-electoral context. Itis concluded that the regulation of social networks is necessary, but must respect democratic principles, balancing freedom and responsibility.
