Réquiem por la jurisdicción universal según el Tribunal Europeo de Derechos Humanos: de Naït-Liman c. Suiza a la sentencia en el caso Couso Permuy c. España
This article critically analyzes the development of the principle of universal jurisdiction in the most recent jurisprudence of the European Court of Human Rights. Specifically, it examines the progression from the Grand Chamber’s decision in the case of Naït-Liman v. Switzerland to the Chamber judgment in the case of Couso Permuy v. Spain. In this context, besides addressing cases such as Hussein and Others v. Belgium and M.M. v. France, special attention is given to the resolution in Couso Permuy. This judgment can be understood as the Court closing the path it began by evaluating the right of access to a court in cases of civil universal jurisdiction, extending to processes of criminal universal jurisdiction in accordance with the 1949 Geneva Conventions.
